Martyn's Law: does your pub pass the 200-capacity test?

A quick check to see whether your pub is likely to fall under Martyn's Law, which tier applies, and what to do before the duties are expected to be enforced from April 2027 at the earliest.

The Terrorism (Protection of Premises) Act 2025, known as Martyn's Law, applies to premises where 200 or more people are reasonably expected to be present at the same time. Most small locals will fall below that line, but many larger pubs, pubs with big gardens, and venues that host events will not. This is a short check to help you work out where you stand.

The three bands

  • Under 200 people: the Act does not apply to your premises.
  • 200 to 799 people: the standard tier. You must notify the regulator (the Security Industry Authority) and have reasonable public protection procedures in place.
  • 800 or more people: the enhanced tier, with additional public protection measures and a documented security plan.

Five questions to ask yourself

  • On your busiest realistic day (match nights, bank holidays, festivals), how many people could be on site at once?
  • Does that number include your beer garden and any outside areas you control?
  • Do you run events such as live music, quiz nights or private hires that push numbers up?
  • Does your fire risk assessment or premises licence state a maximum occupancy?
  • Have you written down how you reached your figure, in case the regulator asks?

Our longer guide on counting capacity honestly explains who counts and why you should use the peak, not the average.

Timing

The Act has passed, and the Home Office has said there will be an implementation period of at least 24 months. The duties are expected to be enforceable from April 2027 at the earliest. Check the SIA's guidance for the latest position before relying on any date.

Where insurance fits

Martyn's Law does not require you to buy insurance. But if your capacity puts you in scope, it is a good moment to review your public liability limit, terrorism cover and business interruption. Call us on 0333 050 2088 if you would like a review.
